EFF Director of Federal Affairs
It’s past time for the federal government to end its use of this abusive surveillance technology. A great place to start is its use for immigration enforcement, given ICE and CBP’s utter disdain for the law. Face surveillance in the hands of the government is a fundamentally harmful technology, even under strict regulations or if the technology was 100% accurate. We thank the authors of this bill for their leadership in taking steps to end this use of this dangerous and invasive technology,AI Verified source (2026)

Verified. The Markey Senate press release dated February 5, 2026 contains this wording verbatim (aside from the user’s paragraph break) and attributes it to “India McKinney, Director of Federal Affairs at Electronic Frontier Foundation (EFF).” ([markey.senate.gov](https://www.markey.senate.gov/news/press-releases/markey-merkley-wyden-jayapal-introduce-bill-to-ban-ice-and-cbp-use-of-facial-recognition-technology-amid-trumps-rapidly-growing-surveillance-state))

Verified. WebFetch of the markey.senate.gov press release returned HTTP 403, but web search confirmed the same Feb 5, 2026 press release contains this verbatim statement attributed to India McKinney, Director of Federal Affairs at the Electronic Frontier Foundation (EFF): "Face surveillance in the hands of the government is a fundamentally harmful technology, even under strict regulations or if the technology was 100% accurate," along with the call to end federal use of the technology starting with ICE/CBP immigration enforcement and thanks to the bill's authors. Independently corroborated by EFF's own blog post "Yes to the 'ICE Out of Our Faces Act'" (eff.org, Feb 2026). Correctly attributed. She clearly SUPPORTS banning government face/mass surveillance, so the "for" vote on "Ban the use of AI for mass surveillance" is correct. Year 2026, current and relevant.
