My policy approach is clear--we need a strong Federal AI framework that protects consumers, workers, children, and creators while sustaining innovation and U.S. technological leadership. But until we set a clear Federal standard, we cannot and should not preempt state AI laws. Preemption leaves a vacuum. Preempting state AI laws before a Federal framework exists leaves consumers with no protection at all. In fact, states are currently the only actors policing AI harms. [...] State laws are among the only legal protections Americans have from AI's harms today, and Congress should not preempt state statutes without commensurate Federal protections. [...] Congress should not undo these efforts without commensurate, legally enforceable consumer protections.
