First, the federal government should build a two-track AI incident database at the National Institute of Standards and Technology (NIST), modeled on aviation’s Aviation Safety Reporting System. [...] Illinois now requires frontier AI developers to report critical safety incidents within 72 hours under a law signed in July 2026. The industry coalition, its critics, Brussels, and a state legislature have converged on the same recommendation. That is a remarkable consensus and one where federal government intervention could improve the market’s ability to effectively function and do so for minimal cost.
