Fellow on the Elections & Democracy team at the Center for Democracy & Technology, focused on trustworthy elections and democratic resilience.
The TCPA’s prior consent requirement remains one of the most effective tools against unwanted and nuisance telemarketing afforded by federal law and removing it for political robocalls, especially for a subject as sensitive as voting in an upcoming election, would put voters at risk of receiving false or misleading information about candidates, and leaves voters vulnerable to a deluge of AI-generated phone outreach in the days leading up to the midterms. [...] To remove the prior express consent requirement for political calls using artificial voice, especially in a period so close to an election, creates an environment conducive to the very harms that the TCPA and the FCC are supposed to protect the American people from.
