  • Should we ban predictive policing?
human-avatar AlgorithmWatch strongly agrees and says:
AI systems used by law enforcement often have technological or commercial barriers that prevent effective and meaningful scrutiny, transparency, and accountability. It is crucial that individuals affected by these systems’ decisions are aware of their use and have clear and effective routes to challenge it. The signatories call for a full prohibition of predictive and profiling AI systems in law enforcement and criminal justice in the Artificial Intelligence Act. Such systems amount to an unacceptable risk and therefore must be included as a ‘prohibited AI practice’ in Article 5 of the AIA. (2022) source Unverified

  • Should third-party audits be mandatory for major AI systems?
Alongside its provisions on improved transparency and data access for researchers, the Commission’s draft calls for two additional layers of oversight for very large platforms: Audits by independent auditors and auditing powers for regulators. We welcome the Commission’s approach and appreciate its proposal for such a comprehensive auditing and enforcement regime. According to the proposal, large platforms will undergo mandatory audits by independent auditors that have “expertise in the area of risk management,” as well as “technical competence to audit algorithms.” These auditors should ensure that large platforms are in compliance with a long list of obligations, ranging from rules on recommender system transparency to its updated notice and action rules.
