The following AI incidents shall be subject to mandatory reporting to the NAIRP within the timelines specified: deaths or serious physical harm attributable to an AI system (within six hours); significant violations of individuals' fundamental rights caused by AI decisions (within twenty-four hours); critical AI system failures in High Risk AI systems (within forty-eight hours); AI system behaviors materially deviating from certified specifications (within seventy-two hours); and AI-enabled data breaches affecting personal data of one thousand or more data subjects (within seventy-two hours).
