This article examines a doctrinal confusion that has shaped a decade of legal scholarship on artificial intelligence: the conflation of the question “should an autonomous AI system hold legal personality” with the distinct question “to whom should an autonomous AI system’s acts be attributed.” Courts and legislatures confronting autonomous AI agents have, almost without exception, answered the first question in the negative. [...] The article concludes that attribution, not personality, is the doctrinally load-bearing concept, and that regulatory energy currently spent debating electronic personhood would be better directed at closing the attribution vacuum within existing private law categories.
