How can bad actors be deterred from and held accountable for attempting to unfairly influence elections or falsely impugn election outcomes by using artificially generated deepfakes? The Task Force should propose model state legislation prohibiting the use of artificially generated deepfakes for the purpose of harming election officials or candidates for public office or for the purpose of improperly influencing elections or election outcomes. The proposed model legislation makes it a crime to create a false impression of voter fraud, falsely claim or imply that an election has been stolen, falsely impugn the integrity or security of an election or balloting system, falsely discredit the veracity of electoral results, or otherwise convey false information intended to erode confidence or participation in an election, unless the deepfake contains a specified disclosure stating that it is a deepfake.AI Verified source (2024-05-06)

ai_verified: The quote explicitly calls for legislation that would make election-related deepfakes a crime, including use to harm candidates, mislead voters, or erode confidence in elections. That clearly supports criminalizing deepfakes and malicious AI-enabled electoral interference.

The quote clearly supports criminalization: it calls for legislation "prohibiting the use of artificially generated deepfakes" to improperly influence elections and says the proposal "makes it a crime" to use such false deepfakes in election contexts.

The quote clearly supports legislation banning deceptive AI-generated deepfakes used to harm candidates or improperly influence elections, including requiring disclosure if content is a deepfake. Although it discusses model state legislation and is broader than only federal candidates, it still clearly implies support for prohibiting deceptive AI-generated media of election candidates.

The quote is authentic. On the American Bar Association page titled “Deepfakes and American Elections,” the page header lists author “N. David Bleisch” and date “May 06, 2024,” and lines 73–75 contain the quoted text verbatim at the stored source URL. Disputed
The quoted text does appear verbatim on the cited ABA webpage in the "Problem Statement" and "Proposed Solution" sections ("How can bad actors be deterred..." and the following paragraph). However, the page identifies N. David Bleisch as the author, and it expressly says the views are those of the author(s), "not those of the Task Force or the ABA." A later ABA Task Force report also lists "Deepfakes and American Elections" as a paper "by N. David Bleisch." So the text is real, but attributing it to the American Bar Association Task Force for American Democracy is materially misleading. The page is dated May 6, 2024.
