[🇺🇸 Congress, Mar 2025] Prohibiting deceptive AI-generated media of federal election candidates

Key insights

Many supporters combine bans on deceptive deepfakes with disclosure rules, treating transparency and prohibition as complementary tools.
Supportive quotes often narrow the target to false depictions of candidates, intent to mislead, or the period just before an election rather than all AI-generated political content.
Opponents generally object less to deception itself than to government deciding what political speech is false, misleading, or punishable.
Election officials, lawmakers, advocacy groups, and some technology or AI companies all appear among supporters, while free-speech and civil-liberties advocates provide much of the opposition.
Several quotes describe existing or proposed rules in other jurisdictions, suggesting this debate is shaped by a broader move toward labeling, timing limits, or deepfake-specific offenses.

Arguments for

Protect election integrity

Supporters say deceptive AI-generated audio, images, and video can manipulate voters, spread disinformation, suppress voting, and undermine confidence in elections. Because these materials can falsely portray candidates or election information as real, they describe them as a serious threat to democracy.

The health of our democracy is on the line as deepfakes and AI-generated content are being used to manipulate voters. If we don’t act now, our elections will be flooded with increased misinformation that threatens our ability to determine fact from fiction, [...]. My Protect Elec…

Ban candidate impersonation

Proponents argue the law should specifically prohibit AI content that uses a candidate's likeness, voice, or image to misrepresent positions, conduct, or identity, especially in campaign messages and ads. They present this as a targeted response to fraudulent candidate smears and impersonation.

Update rules for deepfakes

Supporters contend that AI has become cheaper, more refined, and more accessible, making convincing deepfakes easier to produce and harder to dismiss. They argue election law must keep pace with these rapidly evolving tactics through clear guardrails and deterrence.

Disclosure builds trust

Many supporters pair restrictions with clear labeling or disclosure requirements so people can tell when election content is AI-generated or altered. They argue transparency helps voters make informed decisions, reduces deception, and preserves trust in digital information.

Arguments against

Political speech concerns

Opponents argue it is not the government's role to punish speech because it is false or deceptive, and they say criminal or civil penalties for election-related deepfakes raise serious First Amendment problems. In this view, political speech and commentary should not be policed by the state.

Vague enforcement standards

Critics say proposals can rely on underdefined terms and broad thresholds, giving regulators wide discretion to decide what counts as materially deceptive or misleading. They warn that this risks letting government pick truth from falsehood and could chill lawful political expression or end up protecting incumbents.

The lack of a definition of artificial intelligence (AI) in this legislation is extremely troubling for free speech. S. 2770 would give un-elected, un-appointed career staff in the FEC’s Office of General Counsel initial authority to make recommendations to the Commission on whet…

Better speech, not bans

Some opponents contend the deeper problem is false information generally, not AI itself, and say voters should be trusted to judge political messages for themselves. They argue better speech, rather than government bans, is the proper response and that restrictions on unpaid distribution can be counterproductive.

A media environment with more false and deceptive information is not a good thing for our society, but it is not the government's job to fix it. [...] Let's trust the American people, not the government, to decide for themselves how AI should be used in political advertising and …

Middle ground

Narrow limits and exceptions

A narrower approach would focus on realistic candidate impersonations or other false depictions meant to mislead voters, often during defined pre-election periods, while preserving room for parody or satire. This approach stresses precise drafting, intent standards, and limited scope so election protections can be reconciled with free expression.

With the exception of parody and satirical content, the existing offence against impersonating certain electoral actors (e.g., the CEO, a candidate) with the intent to mislead voters will be expanded to ensure that it applies to realistic deepfakes.

David M. Scanlan · 2024 · full quote

Most supportive quotes treat deceptive AI candidate media as a fast-growing risk to voters and election legitimacy, often calling for both bans on fraudulent depictions and clearer disclosure rules. The opposition focuses on constitutional and institutional objections, especially the danger of vague standards and government enforcement against political speech. The main area of nuance is how narrowly any response should be drawn, including its timing, intent requirements, and exceptions.
