[🇺🇸 Congress, Feb 2026] Directing the FCC to address AI-generated robocalls

Key insights

Across the quotes, the dominant framing is consumer protection from scams, fraud, and unwanted calls rather than opposition to AI as such.
Several speakers specifically emphasize seniors and other vulnerable communities, and AARP-backed quotes highlight older adults' concern and fear around scam calls.
The remedies proposed in the quotes span multiple layers: enforcement of illegal calls, technical authentication and numbering reforms, disclosure and consent rules, and congressional briefings.
Multiple congressional and committee statements both commend the FCC's existing declaratory ruling and argue that rapidly developing AI is becoming harder to detect, suggesting prior action is seen as helpful but not sufficient.
Support for FCC action appears across congressional, regulatory, advocacy, state-level, and trade-group voices identified in the bios.

Arguments for

Protecting consumers from AI scams

Proponents say AI-generated robocalls and texts are being used by criminals to trick consumers out of money, sometimes by impersonating loved ones, and that older adults and other vulnerable communities are especially exposed. They argue stronger FCC safeguards would better protect Americans and give them greater peace of mind.

Our bipartisan measure helps protect consumers from bad actors who use AI to scam Americans out of their hard-earned money. Criminals are increasingly using AI in robocalls and text messages to trick consumers—stealing billions of dollars from their victims each year. Strong safe…

Adapting to evasive technologies

Supporters argue the threat is becoming more technically sophisticated through voice cloning, number cycling, caller ID spoofing, and rapidly developing AI that is harder to detect. They say the FCC should respond with clear, enforceable standards and stronger authentication and numbering measures across the call path.

Advances in artificial intelligence and voice-cloning technology have made fraudulent schemes increasingly sophisticated, while practices such as “number cycling” allow criminals to rapidly switch phone numbers and evade detection. The letter urges the FCC to adopt clear and enfo…

Enforcing robocall laws

Another line of support emphasizes that anti-robocall rules need firmer enforcement. These quotes call for prioritizing FCC resources, using existing laws, closing loopholes, and giving victims or agencies more power to hold illegal callers accountable.

Like most Americans, I’ve experienced the nuisance of constant robocalls. At best, these calls are an insatiable annoyance, and at worst, these calls prey on consumers by trying to undermine someone’s personal privacy and financial information. It’s got to stop. The Protecting Am…

Disclosure and informed consent

Some supporters focus on transparency, arguing that people have a right to know when a call is generated by AI. They favor tying consent to an upfront disclosure, so undisclosed AI-generated calls would not count as consented-to calls.

I think people have the right to know if they’re getting a political phone call that is not the person on the line and it’s generated by AI.

Congressional oversight and updates

Supporters also argue that Congress should keep close oversight of this issue by directing the FCC to brief lawmakers promptly on illegal AI-generated robocalls. In these quotes, the case for a briefing rests on the view that FCC action is underway but the technology is evolving quickly and becoming harder to detect.

In an effort to protect the American public from the proliferation of increasingly complex scams, this year’s bill includes Shaheen-led language expressing concern about the dangers posed by AI-generated robocalls and directing the Federal Communications Commission (FCC) to brief…

Middle ground

Careful, framework-based rulemaking

Some supporters distinguish between AI's beneficial uses and its misuse by bad actors, arguing that the FCC should proceed carefully while building on existing laws and authentication frameworks. This more targeted approach emphasizes calibrated rules, including clearer consent and disclosure standards, rather than treating AI robocalls as wholly separate from current consumer-protection tools.

The innovation that comes with using artificial intelligence has the potential to bring incredible amounts of good to our lives, with the understanding that bad actors will and can take advantage of that. Almost all Americans have been affected by scams through robocalls and we m…

In the quotes provided, there is little visible disagreement over whether AI-generated robocalls warrant FCC attention. The main variation is in emphasis: some speakers stress scam prevention and vulnerable consumers, while others focus more on technical standards, disclosure and consent, enforcement tools, or continued congressional oversight as detection becomes harder.
